WHO IS RESPONSIBLE?

In terms of South Africa’s Extended Producer Responsibility (EPR) regulations, any party placing regulated products on the market carries a legal duty to ensure those products are collected and responsibly managed at end of life. Compliance is mandatory and subject to oversight by the Department of Forestry, Fisheries & Environment (DFFE).

Importers bring products into South Africa for sale and are therefore the first point of legal accountability. Under EPR, they must take responsibility for ensuring those products are collected, reused, recycled or safely disposed of at end-of-life.

Manufacturers who produce goods locally are directly responsible for the full lifecycle of their products. EPR places the duty on them to manage the take-back, recycling and recovery of waste from the products they put into the market.

Refurbishers extend product life by repairing and restoring goods, meaning they actively influence waste streams. Under EPR, this role is recognised as part of product stewardship and they must ensure responsible end-of-life outcomes.

Resellers sell products into the South African market and therefore become accountable for products they place on shelves. EPR makes them responsible for participating in recycling schemes and supporting take-back systems.

Online sellers reach consumers without physical stores, but under EPR they are equally responsible for products they bring into the market. They must support compliance mechanisms for collection and recycling.

Consumers ultimately generate waste when products reach end of life. EPR requires that consumers take part in responsible disposal or return schemes, contributing to the circular economy and ensuring materials are recovered.
